Welcome to The Washe. These Terms and Conditions ("Terms") govern your access to and use of The Washe platform, website, mobile application, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing our website, or using any of our Services, you agree to comply with and be legally bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, you must not use our Services.

2. Eligibility

You must be at least 18 years of age to use our Services. By using The Washe, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

Creating an Account

To use certain features of our Services, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem appropriate.

4. Services for Customers

Service Description

The Washe connects customers with independent Washees who provide laundry services. We facilitate this connection but do not directly provide laundry services.

Pricing and Payment

• Prices are displayed before you confirm your order
• You agree to pay all charges incurred for services rendered
• Payment is processed through our secure payment processor
• We reserve the right to change our pricing at any time
• All sales are final unless otherwise stated

Cancellations and Refunds

• You may cancel orders before acceptance without charge
• Cancellations after pickup may be subject to fees
• Refunds are issued at our discretion on a case-by-case basis
• Damaged items are covered by our damage policy (see Section 8)

Customer Responsibilities

As a customer, you agree to:

• Provide accurate pickup and delivery information
• Ensure laundry is accessible at scheduled times
• Not include prohibited items (see Section 6)
• Treat Washees with respect and courtesy
• Pay all charges in a timely manner

5. Prohibited Items and Conduct

Prohibited Items

The following items may not be processed through our Services:

• Items contaminated with hazardous materials
• Items with bedbugs or other infestations
• Illegal items or contraband
• Items of exceptional value without prior arrangement
• Firearms, weapons, or ammunition
• Perishable items or food

Prohibited Conduct

You may not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, threaten, or harm others
• Provide false or misleading information
• Attempt to circumvent our payment system
• Use our Services for any illegal purpose
• Interfere with the operation of our Services

6. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, and software, are the property of The Washe and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

7. Limitation of Liability

Service Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or secure.

Damage and Loss

While we take reasonable precautions, we are not responsible for:

• Normal wear and tear on clothing
• Damage resulting from manufacturer defects
• Items without care labels or with illegible care labels
• Color bleeding or fading from repeated washing
• Shrinkage within industry-standard tolerances

Our liability for damaged or lost items is limited to the lesser of:

• $500 per order
• 10 times the cleaning charge for the affected item(s)
• The actual value of the item(s)

Limitation of Damages

To the maximum extent permitted by law, The Washe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

8. Indemnification

You agree to indemnify, defend, and hold harmless The Washe, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit through our Services

9. Dispute Resolution

Informal Resolution

If you have a dispute with The Washe, please contact us first at info@thewashe.com to attempt to resolve the issue informally.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the The International Centre for Dispute Resolution Canada. You agree to waive your right to a jury trial and to participate in a class action lawsuit.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our Services will cease immediately.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Washe regarding our Services and supersede all prior agreements and understandings.
